Espacio Erre is one of the first Mexican conscious fashion brands and a consignment store for items, clothing and accessories from luxury brands and emerging brands. The products sold by Espacio Erre are completely original items, in good condition and if they are second-hand they are of quality as if they were new. The goal is to put the best brands at your fingertips, generating a culture of sustainability, as well as promoting upcycling and original brand designs.
In this document we describe the Terms and Conditions that will regulate the purchase and sale of products on the official website www.espacioerre.co , in the physical store, on the official social networks of Espacio Erre : Instagram, Facebook, Tik Tok, Pinterest and Youtube; the content, photographs, advertising, digital and printed material for advertising purposes, product or teaching samples, legal documents, brands and products that the brand generates to achieve a larger audience among people and their customers.
The following Terms and Conditions will apply to our clients, brand users, contractors, social media followers, website users and/or suppliers; these terms and conditions are accepted by mutual agreement between Espacio Erre and you ( client) .
Before making a purchase, I ask you to please read this document carefully, as it will govern the purchase and sale. Please consider that at the time you make a purchase, order a product(s) or request the delivery of a product(s), with any of these acts, you will be accepting these terms and conditions, regardless of whether or not you have read them. As a consequence, you are obliged to comply with them as they are mentioned.
For this reason, it is important that you understand the information mentioned before requesting and/or purchasing any product. Keep in mind what these " Terms and Conditions " mention; since by using our website, social networks and service, contracting services and/or collaboration, you will be consenting to the conditions of use.
If you do not agree with these terms and conditions, I regretfully ask you to refrain from purchasing the products being sold, as well as from using and accessing any of our social networks, content and website.
Consequently, you (client), follower or user are strictly prohibited from modifying, altering, emulating, deleting, dividing, sharing, marketing, downloading and reusing, whether in whole or in part, the material/content, brands, logos, slogans, trade names, products, advertisements, photographs, advertising campaigns, welcome material, or in general any document, file or product of which you are not the owner or of which you have not been provided authorization for use by XXXXXXXX or the corresponding brand, with or without the intention of damaging or discrediting the brand or supporting brands, with or without an intention or purpose of exploitation and commercialization, with or without knowledge of this document, this except with the explicit written authorization of XXXXXXXX and/or the owner of the corresponding brand.
The products sold by Espacio Erre are intended for people of legal age who have the capacity to exercise their rights, meaning that they are not under guardianship or interdiction, and in the case of a minor, explicit written authorization will be requested from their parents or guardians.
Espacio Erre reserves the right to modify these terms and conditions without prior notice and at its discretion according to the needs of its customers, suppliers and followers. The Terms and Conditions that will govern your purchase will be those in force and posted on the website at the time of your purchase.
PRODUCTS
Espacio Erre is a brand that acts as a commercial intermediary for consignment products. Customers can find products from direct suppliers, as well as from third parties who decide to sell their garments, luxury brands or emerging brands, guaranteeing each customer the quality, certainty, security and peace of mind that they are acquiring original products.
PRODUCTS ON ORDER
If you request custom-made/over-ordered products from luxury brands or emerging brands, you should bear in mind that you will be asked for 100% of the total amount of the order you place in order to confirm the order. Once the product is to be delivered, Espacio Erre will notify you of this situation.
PRODUCT FEATURES
You ( customer ) must consult the product description before making the purchase so that you know exactly the characteristics, qualities and specifications of the product you wish to purchase, since in the event of a claim due to the characteristics of a product that was specified before making the purchase, it will not be susceptible to a claim or refund.
Espacio Erre will describe the products with the greatest accuracy and adherence to the characteristics of each product. In case there is any doubt about the characteristics of the product(s); you ( customer ) may request more information through the means of contact, which could be via email info@espacioerre.com or by direct message on any of Espacio Erre 's social networks ; since once an order has been generated, there will only be 24 hours from receiving the purchase confirmation to cancel it; however, consider that Espacio Erre does not accept changes or returns of products, unless you speak with the brand in the case of an emerging brand and it is the brand itself that makes the change or refund.
BUYING PRODUCTS ONLINE
To make a purchase, you must enter the website www.espacioerre.co and select the products of your choice, which will be sent to an order cart; you can click on the order cart to view the products you have chosen; once you ( customer ) have finished choosing the products you wish to purchase, make sure the quantity and product(s) are correct; to complete the purchase, you will have to click on the complete purchase button.
Before continuing with the purchase process, I suggest you check that the quantity and products selected correspond to those chosen, since Espacio Erre will not be responsible for any error resulting from the selection and number of items selected by you ( customer ).
Once the order has been confirmed, you ( customer ) must register on the www.espacioerre.co “Website” platform, creating a customer identification account, this on the same “Website” of www.espacioerre.co; to register the account, you ( customer ) must enter your complete data, such as:
● Full Name
● Email
● Generate a password (confidential, only you will know it)
Once the username and password have been generated by you ( customer ) with the correct data; the Website will assign an order number to the order; you will be asked for the shipping address and telephone number; so that you can then generate the payment for the product(s); before generating the payment, you will be asked to choose the payment method you prefer, this may cause that depending on the selected payment method, you may be asked for personal data on the selected payment platform (Kueskipay, Aplazo, Mercado Pago, offline method) entering the data requested according to the portal of the selected payment method.
Once the purchase is confirmed, Espacio Erre will have up to 72 hours from the time of purchase confirmation to contact you ( customer ) and coordinate delivery in case of physical delivery or provide you with the shipping guide with which your order will be delivered.
PRICE
The price of each of the products varies, as it will depend on the type of product, brand and characteristics of the same; the prices can be seen in each article on the website www.espacioerre.co, the price shown on our website is the one that will be respected at the time of your purchase, however consider that the products may be subject to price changes without prior notice because they are directly subject to the price dictated by the distributor; in case there is an error in the price or the price of an item cannot be seen, please write via social networks or email info @espacioerre.com to remedy this situation and thus provide you with an answer.
The prices shown on the website already include value-added tax; the price shown for each product does not include the cost of domestic shipping (delivery address), as this value will be added to the final price of the order, which will depend directly on the weight, address of the customer, the courier service selected and the item in case it requires insurance.
The delivery cost for each order will depend on the rate indicated by the courier company you choose.
CLEARANCE OR PRICE REDUCTIONS
Espacio Erre permanently offers products on sale; the prices of the products on sale are established in proportion to the defect that the product has; the products that are susceptible to liquidation are those that have a factory defect, aesthetic characteristics that are reflected as damage to the packaging or content of the product, missing parts, missing accessories in the product and/or a direct affectation on the product that diminishes its quality or quantity, when the customer decides to purchase one of these products, they must understand that the product they purchase will not be new or with the quality that a new product would have; since it will have a defect or damage that must correspond to that described on the website.
Products that are on sale may be new products that have a lower price due to a promotion. In these cases, Espacio Erre will establish, through advertising on its social networks and website, the duration of said reduced price, conditions or terms to guarantee the mentioned price.
PROMOTIONS
Prices provided as promotions will be subject to availability and inventory of products at the time of the promotion.
Promotions provided on social media and the website are temporary and exclusive to Espacio Erre. These promotions can be purchased through the website. These promotions will be applied under the conditions mentioned on the portal and social media, depending on the number of products in stock.
If the promotion or the products on promotion end, the customer should not understand this action as discrimination or denial of service.
PAYMENT METHODS
We accept any of the following as payment methods:
● Credit and/or Debit Cards.
● Cash payments (applies to the physical store exclusively in Guadalajara, Jalisco) ● Electronic transfer or deposits in OXXO.
● Market Payment
● Monthly payment: Kueski Pay, Deferred
The payment can be confirmed by the customer, once he has registered on the website and provided the data for delivery of the order; once the purchase process has been completed on the website and depending on the payment method selected by the customer, when the payment method is not through the website, we ask that you send us proof of payment, so that we can confirm the payment and prepare the order.
In the event of any failure to process the purchase of products on the website, you will be notified of the failure and consequently the impediment to process the payment. It is Espacio Erre 's responsibility to resolve this failure and notify the ( customer ) so that they can complete their purchase process.
In the event that the errors arise from transactions, double charges, payments that are not reflected in the Espacio erre bank account , refund of the amount paid in the event of having requested the cancellation of the order or any other situation that may arise with the client's credit and/or debit card(s); the client understands that he/she must contact the bank that issued his/her card(s) so that the bank can proceed to resolve the error or situation that occurred.
Please note that in order for your order to begin processing and to be able to send you the shipping guide, the payment must be reflected in the Espacio Erre account ; for this reason, consider that the time mentioned in the product purchase section will count from the moment you (customer) receive payment confirmation from Espacio Erre .
PAYMENT METHODS WITH DEBIT OR CREDIT CARDS
When registering the customer's account on the XXXXXXXX website, a debit or credit account must be associated to be the method or means of payment chosen by the customer and to carry out the transaction with reference to the purchase of products that they have chosen. Customers have the obligation to verify the data registered in the payment methods of the account to purchase products on the website; for this reason, the customer will be fully and exclusively responsible for the data and payment methods that are registered by themselves, excluding Espacio erre from all responsibility for any error, defect or action contrary to law that may arise.
In the event of any error in the account that the client has registered and entered into the website, this will be the exclusive responsibility of the client and the bank to which his/her bank account belongs.
ELECTRONIC TRANSFERS OR DEPOSITS VIA OXXO
When the customer wishes to make their payment by electronic transfer or deposit via Oxxo, we ask that you send us a message via instant messaging through our social networks or email -----@espacioerre.com so that you can mention the products you want, the sum of amounts can be made and we can provide you with the account where the payment can be made, according to the payment method chosen (via Oxxo or electronic transfer).
OFFLINE METHOD
When the customer selects this payment method, the website will automatically display the information so that you ( the customer ) can know the bank details, the validity period of said bank reference, the name of the account holder, the amount to be paid, etc.
If the time mentioned in the payment method is exceeded, we will ask you to place the order again, since the system cancelled the order and payment reference due to exceeding the established time. When generating the order again, you will be provided with a new payment reference, with a new time period to make the payment.
Once the transfer or deposit has been made, we ask that you send us a photo of the visible proof of payment through the communication channel where the first communication was established, so that
We will confirm receipt of payment and send you an email with the order confirmation and shipping guide if it is outside of Guadalajara, Jalisco, or schedule the day to pick up the order at the physical store (only applies in Guadalajara, Jalisco).
CASH ON DELIVERY
This payment method can only be carried out in the physical store located in Guadalajara, Jalisco.
This payment method is based on paying at the time the customer is receiving the product. For purchases made in the physical store, the customer can pay in cash or by card.
PAYMENT MARKET, KUESKI PAY AND DEFERMENT
When payment is made through Mercado Pago, Kueski Pay and/or Aplazo, payment will be made in installments, that is, in installments, however, you will be able to enjoy your product(s) from the moment you have made the purchase, regardless of the term chosen on said platforms. Please note that if you choose one of these platforms, you will not have the right to cancel your order under any circumstances, since the money cannot be returned or the purchase and payment order cancelled on said platforms.
Contributions, payment dates, amounts, surcharges, interest rates or any additional charges will be in accordance with the platform you have chosen, leaving XXXXXXXX outside of said contractual relationship between you and the payment platform.
Only with this payment method, you will have 1,2,3,4,6 or 8 fortnights to make the payment for your order, however, this information will depend on the platform and decision you make at the time of purchase.
DELIVERY
Espacio Erre only has two ways of order delivery: physical delivery (in store) and delivery by parcel service.
PHYSICAL DELIVERY OR COUNTER
This type of order delivery will be carried out immediately at the time of purchasing the product(s). In the case of items that are made to order, luxury brands or ordered from a brand only for collection in the store, this can be collected within the following 48 hours of having made the purchase, the place of delivery will be the store that is established at: xxxxx.
In case of not being able to attend on the established date and place, the client must notify XXXXXXXX 2 hours in advance of the scheduled time, in order to reschedule a new delivery date that has no cost for the client, they must attend on the indicated day, in case of not being able to attend, we ask you to reschedule, however it will be subject to the collection arrangements that are in place.
The customer may only reschedule a maximum of 3 times. If the customer does not attend the appointments, he/she understands and accepts that he/she must pay the shipping costs to his/her home address in order to complete the purchase made, this as a consequence of having failed to attend the generated appointments.
If the customer objects or fails to indicate the parcel delivery service, the customer understands that, with either of these two actions, he or she would be renouncing his or her order, without the right to request a refund of the amount of the order.
PARCELS
This delivery method applies to the entire Mexican Republic. In this mode, the order will be sent to the address that you ( client ) have designated for delivery.
Espacio erre works with various courier companies; delivery time may vary depending on the courier company, however, please note that delivery time may occur between 2 and 15 business days after making your purchase. The time mentioned will be established according to the type of courier you select on our website; Please note that the courier company will be responsible for the time taken for delivery.
In the event that the order suffers any damage (crushed, damaged, opened, violated boxes, damage to the product resulting from mistreatment of the package or in poor condition) attributable to the shipment, Espacio erre will not be responsible for said damage, since in this situation the claim process must be initiated with the selected parcel service.
CANCELLATIONS
Espacio erre will accept the cancellation of orders that have been paid through the website (online store), electronic transfer and/or cash, as long as the cancellation of the order is made within 24 hours of the order being placed.
PRODUCT EXCHANGES AND/OR RETURNS
Espacio Erre will only accept changes that may arise from an error or confusion in the order on the part of Espacio Erre , meaning the shipment of an order that does not correspond to the one requested by you ( customer ), in this case, the customer must give notice via instant messaging via social networks or email info @espacioerre.com , sending video and photographs to show the error, keep in mind that in order for the order change that applies due to the error to be made, all products must be returned as they were sent, including the packaging and the original shipping box.
In the event that there is no error in the order, the customer will not have the right to demand an exchange of products; in the event that the error committed by Espacio Erre is proven , instructions and a return guide will be given so that the incorrect order can be returned and the correct order can be sent.

In case the order cannot be accepted, cancellation can be accepted due to the payment method.
Once the customer receives the instructions to return the package received, he/she must return everything contained in the package, respecting the way in which each product is protected, products and the box in which the package was received; this so that the order received in error can be exchanged for the order originally requested.
Your order will be shipped once the receipt of the incorrect order is confirmed, to confirm that it is complete and in good condition, in case any of the products have been used or damaged by the customer; Espacio erre will ask you to pay for the affected product so that the correct order can be delivered.
Espacio Erre will not accept exchanges and/or returns of products that have been used, damaged and/or mistreated by the ( customer ). This situation results in the fact that we seek to provide each customer with the same experience and quality in the products. If we accept products that have already been used or manipulated by another customer, we would be violating the mission offered by the brand.
In the event that you ( customer ) wish to request a return or exchange of products for a reason other than an error on the part of Espacio erre , you should know that said exchange or refund cannot be generated because Espacio erre works with consignment pieces which, once sold, are removed from the sales catalog. In the event of requesting a return or exchange, this must be done directly with the brand.
For upcycled clothing or luxury brands, changes or returns are not accepted under any circumstances, but if you wish to sell it, we can offer to be a commercial intermediary for the product.
REFUNDS OR ECONOMIC RETURNS
In the case of refunds/economic returns, these will apply as established in the cancellations section. However, please note that the only returns/refunds that will be accepted are those generated from the request for cancellation of orders within 24 hours of having placed an order and that have been paid by means of electronic transfers or cash; this will be as long as they have been requested in the terms established in the cancellations section.
Once the refund has been authorized in accordance with the conditions mentioned in the cancellation section, the purchase will be refunded according to the payment method used (cash or electronic transfers) to cover the payment.
Only in the case mentioned (order cancellation within 24 hours of having requested the order) Espacio erre may refund money, refund requests that are requested as a result of the characteristics of the product, the result it provides to the customer or not meeting the customer's expectations will not be accepted, this in an enunciative but not limiting way; Espacio erre does not accept changes, returns and/or refunds for reasons attributable to the products it distributes.
The refund and/or return must be requested within the following 24 hours after having requested the cancellation of the purchase. If it is requested after this period of time, the refund and cancellation of the order will not be possible.
FRAUD AND BAD FAITH
When the client acts with deceit, bad faith or with the intention of discrediting the brand, he/she must understand that Espacio erre does not consent to or accept these actions. In the event that Espacio erre is the object of an action that aims to damage, discredit and/or manipulate the brand, we inform you that we will refrain from attending to your request(s), this as a consequence of the damage caused by your actions to the detriment of Espacio erre .
This will not mean under any circumstances that Espacio erre is discriminating or unjustifiably denying service.
BILLING
Orders will be billed upon request of the customer, within the month in which the products were purchased.
When requesting an invoice for your order, we ask that you share the following information with us so that we can generate your invoice.
● Name or business name to which the invoice will be issued.
● RFC (Federal Taxpayers Registry)
● Purchase ticket (Folio).
● Use of CFDI (General expenses, acquisition of goods, to be defined, etc.) ● Tax regime
● Tax address ● Email.
BILLING PROCESS
Once you have the receipt or confirmation of purchase with billing code, you can obtain your invoice by sending an email to —- @espacioerre.com , with the information requested above.
By sending the data and the invoice request, you will receive a response within a maximum of 5 business days, via email, in which we will send you the digital tax receipt. If it is not in your email, we will ask you to write to us again, letting us know of the situation so that we can send the digital tax receipt again. As a client, we ask you to verify and validate that the data sent for the invoice is correct, prior to requesting and/or downloading the corresponding invoice, to avoid errors in your accounting.
In the event of errors, please note that these can only be corrected if the claim is made within the month of purchase. If the request is made in a month other than the billing month, we are unable to make the change to the invoice.
INDUSTRIAL PROPERTY RIGHTS
The copyright and/or industrial property rights arising from the content, organization, collection, compilation, information, electronic transfers, designs, digital conversion, logos, photographs, images, slogans, programs, applications, photographs, advertising, marketing strategy or in general any information contained or published on the XXXXXXXX website and social networks of the Espacio erre brand , are protected in favor of Adrián A. Jaramillo García or, where appropriate, in favor of its suppliers and/or their respective brand owners; in accordance with the applicable legislation on industrial property.
Therefore, the client, followers or suppliers are expressly prohibited from modifying, reproducing, altering, emulating, commercializing, sharing, disseminating, dividing, or deleting, by way of example but not limited to, in whole or in part, the notices, brands, trade names, messages, advertisements, logos, photographs, slogans, products or in general any information, indication or physical or intangible material that refers to the intellectual property contained on the website and/or social networks of the brand.
CLAIMS ON INDUSTRIAL PROPERTY
Espacio erre recognizes, respects, safeguards and accepts the industrial property rights of third parties, which is why if a third party other than Espacio erre , whether a client or supplier, considers that their industrial property rights are being violated, we will ask you to notify us of the situation before going to court, so that we can act in accordance with the legislation on this matter and put an end to the violation. If you are the person affected, we ask that you send us an email to —-@espacioerre.com so that we can address and resolve the claim you mention.
JURISDICTION AND COMPETENCE
The Federal Consumer Protection Agency will be competent to resolve any dispute arising from the purchase and sale of products.
In the event of any controversy, XXXXXXXX proposes to you (client) the solution to the possible conflict through alternative conflict resolution mechanisms, that is, mediation and/or conciliation, with the intention of reaching an agreement that is mutually agreed upon between the parties.
Without prejudice to the foregoing, in the event that the parties do not wish to submit to a mediation or conciliation process, they hereby agree that any conflict arising from the interpretation or compliance with this contract will be subject to the jurisdiction and competence of the courts of the state of Guadalajara, Jalisco, and that you ( client ) and XXXXXXXX hereby waive any jurisdiction that may correspond to them by reason of their present and/or future addresses or for any other reason.
